Contractual Conditions

0. PURPOSE
The following General Contractual Conditions regulate the acquisition of products and the hiring of services offered on the website www.hiocio.com, owned by Hi Plans and Activities S.L. (hereinafter, “Hi Plans and Activities S.L”).

The acquisition of any services implies the full and unreserved acceptance of each and every one of the General Contractual Conditions provided, notwithstanding the acceptance of Particular Conditions that may be applicable to the acquisition of certain services.

These General Conditions may be modified without prior notice. Therefore, it is advisable to carefully read them before proceeding to the acquisition of any of the services offered.

1. IDENTITY
Hi Plans, in compliance with Spanish Law 34/2002, July 11th, on Information Society Services and Electronic Commerce, provides the following details:

All notices and communications between Hi Plans and its users shall be deemed effective if made through any of the channels above.

3. SERVICES
The services offered with their main features and prices will appear on screen.

Hi Plans and Activities S.L. reserves the right to decide, at any time, which services will be offering its customers. Therefore, Hi Plans and Activities S.L. may, at any time, add new services to those offered at any given time. Hi Plans and Activities S.L. also reserves the right to withdraw or stop offering, at any time and without previous notice, any of the services offered.

In any case, the hiring of services may only be completed through the User’s signup or registration. Hi Plans and Activities S.L. will provide the interested party with a user name and password, which will personally identify and enable him/her to access our services.

Once logged into www.hiocio.com, the User must follow the instructions provided in the purchase process to hire services. This will imply the reading and acceptance of all general and particular conditions established in www.hiocio.com.

NB: In order to make reservations, the user must be registered.

4. AVAILABILITY AND REPLACEMENTS

SERVICES
Regarding the provision of services, Hi Plans and Activities S.L. will give access to the service after the customer hires it, and then will contact the customer.

Hi Plans and Activities S.L. shall not be liable for any damages that may be caused to the user as a consequence of any failures or disconnections in the network causing suspension, cancellation or interruption of the www.hiocio.com service.

5. HIRING PROCESS
To hire services through on www.hiocio.com, the customer must be of legal age.

In addition, it will be necessary for the client to sign up at www.hiocio.com and to complete a data collection form to provide Hi Plans and Activities S.L. with all necessary details for the contractual process. These details regarding the client’s identity need to be truthful, precise and complete. The client will need to expressly authorise the use of these data by accepting the privacy policy of Hi Plans and Activities S.L.

Follow these steps to hire services:

  1. Go to the Activities section.
  2. Select the desired activity or use the search engine to find one that fits your needs.
  3. State your place of origin, number of adults, children, and date and time of departure and return.
  4. Click on Reserve.
  5. Confirm your reservation.
  6. Wait for Hi Plans confirmation.
  7. Make the payment through the chosen way.

The contract will be digitally stored on the platform.

We also recommended to print and/or keep a hard copy of the contracting general and particular conditions when placing an order, as well as the receipt emailed by Hi Plans and Activities S.L. when completing the process

INVOICING
You will receive an invoice with your order

To this end, the customer will need to consent to the invoice being emailed in a digital format to the contact email address provided.

6. PRICES, EXPENSES AND TAXES
The prices of services offered on www.hiocio.com will be by default in Euros, being able to select the Pound Sterling option. The prices will be guaranteed during the price validity term wherever the purchased product will be sent to, unless there is a print error.

SERVICES
The final prices of all services, together with their features, offers, discounts, etc. appear next to each service offered at www.hiocio.com.

  • All prices include a 21% VAT
  • Additional expenses may apply depending on specific requests by the user.

Service prices may vary at any time, in which case the price applied will be the one in effect on the date the order was placed. In any case, the final cost will be informed to the customer during the electronic purchase before the customer completes the process.

7. PAYMENT METHODS

a. Credit or Debit Card

Pay immediately through our bank’s secure SSL payment gateway. In the event that the order is cancelled and a refund is requested, the amount will be refunded to the same payment card.

b. Wire Transfer

Make a cash deposit or wire transfer to Bankia’s account number: IS8720382254286000668944. The customer’s name and order number must be stated at the time of transfer.

8. REFUND AND CONTRACT WITHDRAWAL POLICY
According to current regulations, consumers and users have the right to withdraw from the contract at any time prior the services. The cliente must pay the management and cancellation fee, if any, except those provided for in articles 107.2 and 108 of Spanish Royal Decree 1/2007 (November 16th), approving the Spanish General Law for the Defense of Consumers and Users.

In the case of stays and day trips, customers who cancel the service must pay, in addition to management fees, a penalty consisting of:

5% of the total amount, if the withdrawal occurs more than 10 and less than 15 days before the beginning of services provision.

15% between days 3 and 10.

25% within the previous 48hs.

Failure to appear on the agreed date for the provision of the contracted services,  you will not be entitled to any refund of the amount paid, except for cause of demonstrable force majeure or agreement between the parties in another sense.

9. LIABILITY AND DISCLAIMER OF LIABILITY

Hi Plans and Activities S.L may suspend, withdraw or cancel all or part of the services contracted at any time and without prior notice. The foregoing provision will not affect those services reserved for registered users or which have been hired in a previous time and are governed by specific terms and conditions.

10. CUSTOMER SERVICE AND COMPLAINTS

To file any complaints or claims with Hi Plans and Activities S.L., customers must contact our customer service department either by telephone at 685419775 or email at info@hiocio.com.

Pursuant to the EU Online Dispute Resolution and in accordance with article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/.

11. APPLICABLE LAW
The present conditions will be governed by Spanish legislation in force.

The language used will be Spanish.
